Terms of Service

These Terms of Service ("Terms") govern your use of the Morning Quest mobile application and website (collectively, the "Service"), operated by Bellini ApS ("we", "our", or "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

The Service is intended for use by parents and guardians who are at least 18 years old. Children use the app under their parent's or guardian's account and supervision. By registering, you confirm you are 18 or older and accept these Terms on behalf of your family.

2. Account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us at support@bellini.app immediately if you suspect unauthorised access. We may suspend accounts that breach these Terms.

3. Subscriptions and billing

Morning Quest offers a free tier and optional paid subscriptions that unlock additional features. Subscriptions are billed through the Apple App Store or Google Play on a recurring basis (monthly or annual, as selected at purchase).

• Trial periods — where offered, a free trial converts to a paid subscription at the end of the trial period unless cancelled beforehand.
• Renewal — subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period.
• Cancellation — cancel at any time through your App Store or Google Play account settings. Access continues until the end of the paid period; no partial refunds are issued for unused time.
• Price changes — we will give reasonable advance notice of any price changes. Continued use after the change takes effect constitutes acceptance.
• Refunds — refund requests are handled by Apple or Google according to their respective policies.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or extract the source code of the app.
• Interfere with or disrupt the Service or servers connected to it.
• Share your account with people outside your immediate family household.
• Submit false, misleading, or harmful content through the Service.

5. Intellectual property

All content in the Service — including text, graphics, logos, illustrations, and code — is owned by Bellini ApS or its licensors and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Content you create within the Service (quest names, custom tasks) remains yours. You grant us a limited licence to store and display that content solely to provide the Service to you.

6. Privacy and children's data

Our Privacy Policy explains how we handle personal data, including data relating to children. By using the Service you confirm you have read and understood the Privacy Policy.

7. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of liability

To the maximum extent permitted by applicable law, Bellini ApS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you in full.

9. Termination

We may suspend or terminate your account if you materially breach these Terms and fail to remedy the breach within 14 days of notice. You may delete your account at any time from within the app. Upon termination, your right to use the Service ceases immediately; Sections 5, 7, 8, and 10 survive termination.

10. Governing law and disputes

These Terms are governed by the laws of Denmark, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Copenhagen, Denmark. If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform.

11. Changes to these Terms

We may update these Terms from time to time. Significant changes will be communicated via an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
